Health Warranty, Receipt of Purchase & Spay/Neuter Contract

This is a legal and binding contract even if you don’t read in it’s entirety, don’t understand it or forget what is says.

Seller's Responsibility:

1.The seller has taken actions to assure that the puppy is in good health upon buyer taking possession and has received the following:


  • Age-appropriate immunizations 
  • Regular De-worming
  • Vet exam 
  • Clean living environment 
  • High quality puppy food


The seller provides warranty against life threatening genetic defects for a period of one (1) year from the date of birth.


Seller states steps have been taken with the sire/dam selection and breeding to prevent genetic life threatening issues. 


Life threatening defects are defined as lethal, meaning they will result in the death of the dog within the 1 year period or medically indicated euthanasia in the 1 year period.


Any suspected life threatening/lethal defect must be confirmed by a licensed veterinarian (including necropsy if the dog dies. Necropsy is at buyers expense).

Seller offers no warranty to dogs eventual size, breeding ability, coat length, tooth health or conformation upon maturity. Seller has responsibly bred the parents to be within the breed standard if purebred but there are no guarantees when dealing with generations of genetics. If your puppy is a hybrid there is no defined breed standard.


-Contracts / Legalities-

 2.Buyer must supply any requested veterinary records related to the dog’s condition to the seller within seven days of diagnosis.


  • Seller has the right to require a second opinion from a veterinarian and/or veterinary specialist of the Seller’s choice at the Seller’s expense. If sellers vet concurs a replacement puppy will be given. If sellers vet dissents no replacement will be given.
  •  If necropsy is performed and results in undetermined or inconclusive diagnosis, warranty is void. No replacement puppy will be given.


3.If a lethal defect is identified within the warranty period,the Buyer has the option to obtain a replacement puppy from the Seller of equal or lesser value from the next available litter.


  • Original puppy need not be returned,provided there is proper documentation of lethal issue and the puppy/dog will die within the 1 year warranty period either by natural means or euthanasia. 
  • Breeder determines which puppy (of equal or lesser value) will be used as a replacement and the wait may be as long as 6-12 months
  •  Color or gender is not warrantied 
  •  Shipping fees will not be refunded,and any costs associated with the shipping replacement puppy are to be covered by Buyer.
  • NO CASH REFUNDS ARE GIVEN 

4.If the puppy is euthanized or in any way disposed of, without a second opinion from the seller’s veterinarian, the buyer waives all rights to a replacement puppy. 

 5.This warranty does not include viral illnesses, parvo, infections, improper bites,retained puppy teeth, undescended testicles, inverted vulva, stress-related illness such as anxiety, liver shunt, hernias(inguinal or umbilical), hypoglycemia, sensitive digestive tract, parasites of any kind (including Giardia or Coccidiosis), cancer, epilepsy(seizures) endocrine disorders, dry eye, stenotic nares or luxating patellas. It also does not include any illness due to the ingestion of foreign objects, food, chemicals or physical injury. This warranty only covers life threatening genetic conditions. Anything that is not a life threatening genetic issue is not covered under any circumstances. If the puppy has not had proper vaccines, preventative medications or wellness visits this guarantee is null and void.

 6.No warranties or guarantees, expressed or implied, are made under this contract except as stated.

  • This warranty is non-transferable.

7.It is to be clearly understood, that the Seller does NOT, under any circumstances, accept responsibility for any veterinarian and/or health care expense such as but not limited to medications, inoculations, surgery, emergency vet bills or any vet bills. 


Buyer's Responsibility: 

1.The Buyer agrees to pay the Seller a total sum of $ __________. This fee does not include shipping. If shipping is required, the Buyer agrees to pay for shipping using a flight nanny or the sellers will hand deliver the puppy for a set fee within their delivery location.

2.The Buyer bears all costs relating to the sale of the above animal, including transportation. The risk of loss,illness or injury to the above animal is on the Buyer at all times after the puppy leaves the Seller.

3.The Buyer agrees to have the puppy examined by a licensed veterinarian within 48 hours of taking possession.

 

  •  Seller has provided a pet insurance policy from Trupanion. It is free for 30 days for the buyer. It is strongly encouraged that the buyer activate the insurance and at least keep it the 30 day period at no charge.
  •  We STRONGLY advise to carry pet insurance whether through trupanion or a company of your choosing after the free 30 days.
  • The Buyer will provide  the proof by way of report/receipt from the licensed veterinarian clearly stating the the puppy has been examined. 
  • If the puppy is not taken to a licensed veterinarian within 48 hours of taking possession, the health warranty is void. NO EXCEPTIONS! PROOF MUST BE RECEIVED WITHIN 3 DAYS OF THE EXAM OR THE WARRANTY IS NULL AND VOID. You can simply take a picture showing the examining vets name and address along with what was performed and the results and text it to me at 479-228-0247 or you can send through Facebook messenger, Instagram messenger or email. rockyoakcavaliers@yahoo.com 
  • Please ensure that the puppy is kept in a kennel or held in the waiting room of a veterinary office, and that the exam room is properly disinfected before the appointment. Do not take the puppy to puppy parks, play grounds or any public place where dogs frequent. In a pet store we strongly suggest you hold your puppy and do not place him/her in the shopping cart.


-Contracts / Legalities-

 8.Do not let the puppy walk on the floor in the veterinary office and ensure the room was cleaned prior to putting your puppy on the table. I recommend bringing a clean towel, puppy pee pad or blanket with you to be safe.

9.The Buyer is responsible for all medical expenses associated with the puppy(including parasites) from the date of possession. Even if parasites are found at the initial exam once taking your puppy home.

  • If you are not willing to treat puppy parasites (sometimes more than one treatment is needed), then please do not buy a puppy. We treat our adults and puppies on a regular schedule and our vet performs a fecal exam, but do to the life cycle sometimes things are missed.
  • It is common for puppy parasites to flourish after joining their new family (stress and change accommodate this). Parasites are easily treatable but can be passed to other dogs. 
  • Do not let your other dogs eat the puppy’s feces and clean it up immediately using proper cleaning chemicals.

10.The buyer agrees to provide the best possible care for their puppy for the duration of his or her life. This includes but is not limited to:

  • Housing the puppy indoors 
  • Feeding only a premium quality, complete food intended for dogs. We highly recommend Royal Canin, Purina Pro Plan Puppy, Nutrisource or Hills Science diet. We do not agree with fad or alternative diets such as raw feeding and will render this warranty null and void if such is the regular way of feeding. 
  • Maintaining your puppy at a healthy weight. Being overweight puts unnecessary stress on their hearts, hips and knees. 
  • You agree to have your puppy/dog seen by a licensed veterinarian for a wellness exam annually 
  • Taking their puppy to the licensed veterinarian if he or she gets sick or is injured 
  • Keeping all immunizations current according to the guidelines of the American Veterinary Medical Association. All vaccinations should be completed at around 16 weeks and boosters given yearly after that.
  • Administering heart worm preventative medication (if living in an area of concern)  The Seller highly recommends the Buyer provide basic obedience training with their puppy within the first year of owning their dog. Please check out the enclosed brochure for Baxter and Bella.

11.The Buyer agrees to postpone strenuous, forced exercise until after their puppy is over one (1) year of age to minimize joint damage as puppies develop.

12.This puppy is not to be resold, rehomed or transferred to anyone else at anytime for any reason.

The Buyer agrees to contact the Seller immediately if the Buyer determines they are unable to keep their puppy for any reason. The Buyer and Seller will jointly determine how the dog will be rehomed. Seller always gets first choice at taking the puppy the back. No refunds will be given. Seller will pay at his/her expense to ship the puppy back to the seller using a flight nanny if appropriate. Buyer agrees to cooperate with getting the puppy back to the seller. If puppy is transferred, rehomed, resold without first discussing with sellers a breach of contract will have occurred and buyer will responsible for paying $5000 to the seller immediately upon breach of contract. If seller has to legally sue the buyer all court cost, attorney fees, filing fees and travel fees will be the responsibility of the buyer to be paid to the seller along with the breach of contract fee.

13.The Buyer agrees to never place their puppy with a rescue group, in a shelter, pound, or similar facility or research laboratory.

14.The Buyer allows the Seller to use any pictures of the dog that the Buyer posts on social media or send to them for the purposes of reposting and sharing on Facebook, Instagram, their website, Twitter, YouTube, etc. or in any manner they choose.


Spay and Neuter Contract

1. Spaying/neutering/ by a licensed, reputable veterinarian is strongly recommended on the above puppy at or before 18 months of age. 

  • We no longer require spay or neutering of any puppy we place, but you will not receive any registration application until we receive proof the puppy has been spayed/neutered. If not received by age 2 years old no registration will be available to you at any time. 
  • All pet homes of registrable purebred dogs will only receive ACA or APRI registration even though parents are AKC. AKC breeding rights can be discussed but only given on a case by cases basis.
  • Cross breeds are not available for registration.
  • To send proof simply send a spay/neuter certificate or receipt to my email address or private message. It must show vets name, address & phone number. It must also show the breed, age and birthdate. Once this is received I will send your application within 10 days.

-Contracts / Legalities-

2.It is understood that at the time of sale that the puppy is not to be used for breeding. It is a representation of its breed and it is structurally and temperamentally suited for a companion dog. It is being sold as a pet without breeding rights and no registration application is given until proof of spay/neuter. 


3.By signing this contract I agree to all of the previous terms of the contract and warranty and acknowledge this is a legal and binding contract. 


Please understand what is covered and what is not covered under this contract before agreeing to it. 


By accepting the puppy on day of delivery I am agreeing it is suitable for sale and I agree to the terms of the contract. If any part of this contract is not followed then breach of contract occurs and seller has the right to forfeit the agreement and sue for breach of contract.

This contract shall be deemed legal and binding between the buyer and seller(breeder) and is under the jurisdiction of the State of Oklahoma and County of Delaware. It is further agreed that should there be any dispute/arbitration between the buyer and seller(breeder) regarding the said dog that the legal venue shall be in the County of Delaware.
